1. Introduction

These terms and conditions govern your use of the website www.ikonik.co.za (referred to as "the Website" or "the Platform") and all transactions entered into with Ikonik Luxury Furniture (Pty) Ltd, a South African private company trading as "Ikonik Luxury Furniture" and "Ikonik".

By accessing the Website or placing an order, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree to any part of these terms, you must discontinue use of the Website immediately.

You must be at least 18 years of age to use the Website and place orders. If you are under 18, you may only use the Website with the involvement and consent of a parent or legal guardian.

2. Definitions

In these terms, the following definitions apply:

  • "Ikonik", "we", "us", or "our" refers to Ikonik Luxury Furniture (Pty) Ltd, trading as Ikonik Luxury Furniture.
  • "Customer", "you", or "your" refers to any person or entity accessing the Website or placing an order with Ikonik.
  • "Products" refers to all furniture, homewares, and related items offered for sale by Ikonik, whether through the Website or other sales channels.
  • "Website" refers to www.ikonik.co.za and all associated pages, content, and functionality.
  • "Order" refers to a request submitted by a Customer to purchase one or more Products from Ikonik.
  • "Transaction" refers to the completed purchase of Products, including payment and order confirmation.
  • "Trade Client" refers to qualified interior designers, architects, developers, and hospitality professionals registered under the Ikonik trade program.
  • "Business Day" means Monday to Friday, excluding South African public holidays.

3. Account Registration

An account is required to make purchases on the Website. When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately at sales@ikonik.co.za if you become aware of any unauthorised use of your account or any other breach of security.

Ikonik reserves the right to suspend or terminate any account that violates these terms, provides false information, or is used in connection with fraudulent or unlawful activity.

4. Products & Made-to-Order Items

All products offered by Ikonik are made to order unless explicitly stated otherwise. Each piece is crafted individually, and production begins only after your order has been confirmed and payment received.

Product images on the Website are representative. Natural materials such as wood, leather, stone, and fabric may exhibit variation in colour, grain, and texture. These characteristics are inherent to the material and are not considered defects.

While we take care to display colours as accurately as possible, we cannot guarantee exact colour representation across all screens and devices. Product specifications and availability are subject to change without notice.

Custom or bespoke commissions may be subject to additional terms, which will be communicated to you at the time of quotation.

5. Pricing

All prices displayed on the Website are in South African Rand (ZAR) and include VAT at the prevailing rate unless otherwise stated. Delivery fees are charged separately and calculated at checkout.

Ikonik reserves the right to correct pricing errors at any time. If a pricing error is identified after an order has been placed, we will contact you before proceeding. Prices are subject to change without prior notice; however, confirmed orders will be honoured at the price agreed at the time of order confirmation.

6. Payment Terms

Online orders: Full payment (100%) is required at the time of placing the order.

Larger or bespoke orders (via direct enquiry): A minimum deposit of 60% is required to confirm the order, with the remaining 40% due before dispatch.

Accepted payment methods: Visa, Mastercard, American Express, and electronic funds transfer (EFT).

Orders are only confirmed once payment has been received and verified. For EFT payments, proof of payment must be submitted to sales@ikonik.co.za. Orders will not proceed until funds have cleared.

7. Order Confirmation & Processing

An order confirmation email acknowledges receipt of your order but does not constitute acceptance. Ikonik reserves the right to decline or cancel any order at our discretion, including where pricing errors occur, products become unavailable, or we suspect fraudulent activity.

Once payment has been received and procurement of materials has commenced, the order is binding.

Standard production lead time is 4 to 6 weeks from order confirmation, with 4 weeks being the most common timeframe. Larger or more complex orders may require additional time. You will be notified if there are any changes to the estimated timeline.

8. Delivery

Ikonik delivers nationwide within South Africa. Delivery fees are calculated separately based on order size, weight, and destination.

Delivery dates provided are estimates only and are not guaranteed. Ikonik shall not be held liable for delays caused by circumstances beyond our reasonable control. Risk of loss or damage transfers to the customer upon delivery to the specified address.

The customer, or an authorised representative, must be present to receive delivery and inspect the goods upon arrival.

International orders: Available by special arrangement. Customers outside South Africa must contact us directly at sales@ikonik.co.za to discuss shipping, duties, and logistics.

9. Inspection & Damaged Goods

You must inspect all goods upon delivery. If any item is damaged during transit, you must notify Ikonik within 48 hours of delivery by emailing sales@ikonik.co.za with:

  • Clear photographs showing the damage
  • Your order number or a copy of your invoice

Ikonik will assess the claim and, at our discretion, arrange for repair, replacement, or a partial credit. Claims submitted after the 48-hour window may not be accepted.

Damage resulting from misuse, improper handling after delivery, or failure to follow care instructions is not covered.

10. Returns, Cancellations & Refunds

As all products are made to order, items are non-returnable and non-exchangeable once payment has been received and procurement of materials has commenced.

Cancellation requests made before material procurement begins will be considered at Ikonik's sole discretion and may be subject to a reasonable administration fee. Ikonik is not obligated to accept cancellations or offer refunds for made-to-order items.

In the event that Ikonik is unable to fulfil an order, a full refund will be issued to the original payment method.

This clause does not limit any rights you may have under the Consumer Protection Act 68 of 2008 that cannot be excluded by agreement.

11. Warranty

Ikonik stands behind the quality of its products. Structural defects in materials or workmanship that arise under normal use within a period of two (2) years from the date of delivery will be assessed and addressed by Ikonik on a case-by-case basis.

The warranty does not cover:

  • Normal wear and tear
  • Damage resulting from misuse, negligence, or accident
  • Exposure beyond the product's intended use (e.g., indoor furniture used in outdoor settings)
  • Unauthorised modifications, repairs, or alterations
  • Variations in natural materials (colour, grain, texture) which are inherent characteristics, not defects

To make a warranty claim, contact sales@ikonik.co.za with your order details, photographs, and a description of the issue. Ikonik reserves the right to inspect the item, in person or via photographs, before determining the appropriate resolution.

12. Trade Clients

Ikonik offers a trade program for qualified interior designers, architects, developers, and hospitality professionals. Trade clients may be subject to additional terms and conditions, which will be provided during the trade registration process.

Trade pricing, payment terms, and project-specific arrangements are available upon application. To enquire about the trade program, contact sales@ikonik.co.za.

13. Intellectual Property

All content on the Website, including but not limited to text, images, photographs, graphics, logos, icons, product designs, and page layouts, is the property of Ikonik Luxury Furniture (Pty) Ltd or its licensors. This content is protected under South African and international intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content on the Website without prior written permission from Ikonik. The Ikonik name, logo, and associated branding are registered trademarks of Ikonik Luxury Furniture (Pty) Ltd.

14. Website Use

You may use the Website for lawful, personal purposes only. You must not:

  • Attempt to gain unauthorised access to any part of the Website, its servers, or any connected systems
  • Use automated tools, bots, or scrapers to extract data or content from the Website
  • Introduce viruses, malware, or any harmful code
  • Interfere with the functionality or security of the Website
  • Use the Website in any manner that could damage, disable, or impair its operation

Ikonik does not guarantee that the Website will be available at all times without interruption or error. We reserve the right to modify, suspend, or discontinue any part of the Website at any time without notice.

15. Accuracy of Information

While we make every effort to ensure the accuracy of information on the Website, errors may occasionally occur. Ikonik reserves the right to correct any errors in product descriptions, pricing, or other content at any time. In the event of a material error affecting your order, we will contact you to discuss before proceeding.

16. Privacy & Data Protection

Your personal information is collected, stored, and processed in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

By creating an account or placing an order, you consent to the collection and use of your personal information as described in our Privacy Policy. We will not share your personal information with third parties except as necessary to fulfil your order (e.g., delivery partners, payment processors) or as required by law.

17. Electronic Communications & Marketing

By subscribing to our newsletter or creating an account, you consent to receive marketing communications from Ikonik, including promotional offers, product launches, and design inspiration. You may unsubscribe from marketing communications at any time by clicking the unsubscribe link in any email or by contacting sales@ikonik.co.za.

Transactional communications, such as order confirmations, delivery updates, and account notifications, will continue regardless of your marketing preferences. This is in compliance with the Electronic Communications and Transactions Act 25 of 2002.

18. Limitation of Liability

To the fullest extent permitted by South African law, Ikonik Luxury Furniture (Pty) Ltd shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to your use of the Website or any products purchased. Ikonik's total liability in respect of any claim shall not exceed the purchase price of the affected product(s).

Ikonik shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, labour disputes, supply chain disruptions, or utility failures (force majeure).

Nothing in these terms excludes or limits liability that cannot be excluded or limited under the Consumer Protection Act 68 of 2008.

19. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from these terms or your use of the Website shall be subject to the jurisdiction of the courts of KwaZulu-Natal, South Africa.

20. Amendments

Ikonik reserves the right to update or modify these terms and conditions at any time. Changes become effective upon publication on the Website. The "Last updated" date at the top of this page indicates when these terms were last revised.

Your continued use of the Website following any changes constitutes your acceptance of the revised terms. Material changes affecting existing orders will be communicated to affected customers directly.

21. Severability

If any provision of these terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

22. Entire Agreement

These terms, together with our Privacy Policy and any additional terms communicated at the time of order, constitute the entire agreement between you and Ikonik Luxury Furniture (Pty) Ltd. No waiver of any term shall be deemed a continuing waiver of that or any other term.
